General Terms & Conditions (GT&Cs)

By engaging our services, you enter into a professional agreement with us. These General Terms & Conditions (GT&Cs) govern the relationship between SwissAnPi ("the Company," "we," "our"), our clients, and any third parties arranging travel on their behalf.

1. Acceptance

By accessing our website or booking our Services, you confirm acceptance of these GT&Cs as binding. For questions, please contact us at anna.pilkevich@gmail.com before making your reservation.

2. Eligibility & Participation

2.1 Age Requirements

Participants under 18 must be accompanied by an adult who assumes full responsibility for them.

2.2 Conduct and Restrictions

Participation while under the influence of drugs or excessive alcohol is strictly prohibited. SwissAnPi reserves the right to exclude any participant whose behavior is deemed disruptive, discriminatory, or disrespectful to the guide, local residents, or Swiss culture. No refunds will be issued in cases of exclusion.

2.3 Pet Policy

Please inform us at the time of booking if you wish to bring a pet. Approval is subject to the specific requirements of the itinerary and local regulations.

3. Health & Safety

3.1 Responsibility & Disclosure

You are responsible for your own physical and mental safety. By booking, you confirm you are in good health and have no conditions that pose risks to yourself or others. Please disclose any mobility or accessibility needs prior to booking so we can attempt to make necessary accommodations.

3.2 Risk Assumption

Travel and outdoor activities in Switzerland carry inherent risks. By participating, you assume these risks and release SwissANPI from liability for personal injury or property loss to the fullest extent permitted by Swiss law.

4. Insurance and Alpine Safety

4.1 Mandatory Personal Insurance

SwissAnPi does not provide insurance for its guests. It is the sole responsibility of the Client to ensure they have adequate insurance coverage, including:

  • Health and accident insurance valid in Switzerland.
  • Personal liability insurance.
  • Travel cancellation and interruption insurance.

4.2 Search and Rescue Costs

In Switzerland, search and rescue operations (including helicopter intervention) are extremely costly and are billed to the individual. We recommend coverage including search and rescue (e.g., via REGA patronage or equivalent international policies) as costs are not covered by standard health insurance in many cases.

SwissAnPi shall not be held liable for any rescue or evacuation costs incurred during a Service.

5. Force Majeure and Alpine Weather

5.1 Weather Conditions

In the Swiss Alps, weather can change rapidly. SwissAnPi reserves the right to modify itineraries at short notice to ensure the safety of our guests. If a specific mountain peak or attraction is inaccessible due to weather, we will provide a high-quality alternative. Such modifications do not entitle the Client to a refund.

5.2 Unforeseeable Events

SwissAnPi is not liable for non-performance due to Force Majeure, including but not limited to natural disasters, avalanches, closure of mountain passes, strikes, or government-mandated restrictions.

6. Travel Documents

Customers are solely responsible for ensuring they possess valid passports, visas, and meet all Swiss entry requirements. SwissANPI is not liable for costs arising from denied entry.

7. Prices, Bookings & Payments

7.1 Pricing

All prices are quoted in Swiss Francs (CHF).

7.2 Booking and Deposits

  • Within 30 days of Service: 50% of payment is required to confirm the booking.
  • More than 30 days in advance: A 20% deposit is required to secure the date.

8. Cancellation and Refund Policy

8.1 Cancellation Requests

All cancellations or modifications must be submitted in writing. To be eligible for a partial refund, notice must be received at least 7 days prior to the scheduled tour date.

8.2 Important Note on Third-Party Costs

Regardless of the notice period, any non-refundable or partially refundable costs already incurred to secure your booking (such as tickets, reservations, or partner services) are exempt from refunds.

8.3 Refund Schedule

Refunds are processed based on the timeframe of the cancellation notice:

  • 30+ days prior to tour: 100% refund (except non-refundable costs)
  • 15 – 30 days prior to tour: 50% refund (except non-refundable costs)
  • 7 – 14 days prior to tour: 25% refund (except non-refundable costs)
  • Less than 7 days: No refund

8.4 Force Majeure

SwissANPI is not liable for disruptions caused by unforeseeable events (e.g., natural disasters, extreme weather, government restrictions).

8.5 Cancellations by SwissAnPi

If we must cancel a service (e.g., guide illness), we will offer an alternative date or a full refund of the Service Price.

9. Scope of Liability

SwissAnPi operates with the highest standards of professional diligence. In accordance with Swiss law, our liability is limited to damages resulting from intent or gross negligence. We assume no liability for slight negligence, indirect damages, consequential losses, or loss of profit.

9.1 Limitation of Liability

Please be advised that we do not assume liability for the following:

  • Indirect Loss: Any instances consequential financial losses.
  • Personal Property: The loss, theft, or damage of personal belongings, including luggage, electronics, and cash. We recommend maintaining personal travel insurance.
  • Third-Party Services: Any services or experiences provided by external partners, such as hotels, mountain railways, and restaurants.
  • Participation Risk: Outdoor activities in Switzerland—including hiking and city walking tours—involve inherent risks. By booking, you acknowledge these risks and agree to follow all safety instructions provided by your guide. Failure to comply with safety guidance voids any liability claims against SwissAnPi.

Any limitation of liability for personal injury or death shall be invalid to the extent prohibited by mandatory Swiss law.

10. Promotional Media

Unless you notify us otherwise before the tour, you consent to SwissAnPi using photos or videos taken during the Service for promotional purposes on our website or social media.

11. Intellectual Property

All content on swissanpi.com, including text, logos, and images, is the exclusive property of SwissAnPi. Reproduction or commercial use without written consent is strictly prohibited.

12. Governing Law & Jurisdiction

12.1 Governing Law

These GT&Cs are governed by Swiss law.

12.2 Arbitration & Venue

Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of the Canton where SwissANPI is registered, or settled via binding arbitration in Switzerland.

13. Amendments

SwissAnPi reserves the right to update these GT&Cs at any time. The version in effect at the time of booking shall apply.
